Mandatory Pennsylvania Liability Coverages
Bodily Injury
If the Pennsylvania auto insurance policyholder is found to be at fault in an auto accident resulting in injuries or fatalities, the following is covered under bodily injury coverage:
- Medical expenses
- Pain and suffering
- Lost wages
- Legal defense if involved in a lawsuit resulting from a car accident

The Pennsylvania auto insurance limits you select will determine the maximum amounts that will be paid per person, per incident, respectively.
Property Damage
If you are found to be at fault in a car accident, the following is covered under property damage coverage:
- Damage to another person's property such as fence, car, or home
- Legal costs associated with a damage incident

First Party Benefits - Medical
Pennsylvania First Party Benefits (FPB) medical coverage is mandatory in Pennsylvania, with $5000 limits being the lowest option.
In the event of a covered incident, certain individuals are eligible for the following benefits:
- Related medical and surgical care
- Essential rehabilitative services such as physical therapy, speech pathology, etc.
- Necessary optometric, dental, psychiatric, and psychological treatment
- Required medications, medical supplies, and prosthetic devices
- Ambulance and nursing service
Pennsylvania FPB-Medical provides coverage to the policyholder, drivers listed on the policy, and relatives living in the same household as the policyholder.
Right to Recover Damages (Tort Options)
The right to recover damages is legally known as tort options. The state of Pennsylvania requires you to select one of the following tort options to define your right to compensation in the event that another party injures you or members of your household in an auto accident:
- Limited Right to Recover Damages (Limited Tort) - If you select the limited tort option, your rights to financial compensation for injuries caused by other drivers will be limited. On the other hand, your premiums for property damage liability, FPB, and FPB Income Loss coverages will be lower than if you had selected full tort. Under the limited tort option, you and other members of your household are entitled to recover damages for medical and other related expenses. However, you will not be eligible for financial compensation for pain and suffering or other non-monetary damages, unless your injuries are categorized as serious such as a life-long disability, an injury resulting in death, etc.
- Full Right to Recover Damages (Full Tort) - If you choose the full tort option, your rights to financial compensation for injuries caused by other drivers is unrestricted. However, your Pennsylvania auto insurance premium will not be reduced. Under the full tort option, you and other members of your household may seek recovery for all medical and out-of-pocket expenses. You are also allowed to seek financial compensation for pain and suffering and other non-monetary damages for injuries caused by other drivers.
Optional Pennsylvania Liability Coverages
First Party - Combination Package Benefit (CPB)
Pennsylvania First Party - Combination Package Benefits (CPB) is an available optional coverage. This is an alternative to buying the other First Party coverages.
The CPB auto insurance coverage provides the named insured and relatives living in the same household a combination of benefits subject to limits of $177,500 or $277,500.
The package includes coverage for medical benefits, income loss, accidental death, and funeral costs. The Accidental Death and Funeral Benefit portions of the coverage are subject to $25,000 and $2,500 limits, respectively.
First Party - Extraordinary Medical
Pennsylvania First Party - Extraordinary Medical is an optional coverage if you have also selected FPB - Medical Benefits coverage with a $100,000 limit.
The coverage is designed to provide catastrophic medical coverage for the named insured and relatives living in the same household, in excess of the base Medical Benefits coverage of $100,000.
This means that Extraordinary Medical Benefits coverage will begin once the $100,000 limit for your medical expenses has been reached under your medical benefits coverage, and will cover your additional medical expenses up to the limit. A maximum limit of $1 million is available.
First Party - Income Loss
If you purchase Pennsylvania income loss coverage, the named insured and relatives residing in the same household are covered.
Income Loss coverage helps you recover up to 80% of your lost earnings if you are unable to work after an auto accident.
This coverage is limited to $2500 per month, with total payments capped at $50,000.
First Party - Accidental Death
Pennsylvania accidental death coverage provides a death benefit if a covered individuals die from accident-related injuries within 24 months of an auto accident.
The coverage will pay $25,000 to the insured's beneficiary.
First Party - Funeral
Pennsylvania funeral coverage provides $2,500 toward funeral expenses if either the insured or a relative living in the same household dies from accident-related injuries.
Uninsured Motorist Bodily Injury
If you choose to have uninsured motorist bodily injury on your Pennsylvania auto insurance policy and you want it to apply to multiple cars, you must select the same limit for each car. The limits must also be less than, or equal to, your bodily injury limits. If the covered individuals are injured in an accident caused by a driver who has no auto insurance, compensatory damages that a policyholder is entitled to receive, will be covered.
Uninsured motorist bodily injury coverage covers the following expenses:
- Lost wages
- Medical expenses
- Other damages
- Injuries sustained in hit-and-run accidents
Uninsured motorist bodily injury provides coverage to the policyholder, authorized policy members, and passengers.
Optional Pennsylvania Vehicle Coverages
Comprehensive
Pennsylvania comprehensive coverage is optional but, it must be included on policies that have collision coverage, and it can not be purchased without bodily injury coverage.
This coverage provides protection for:
- Damage not resulting from a collision such as damage from falling objects, fire, vandalism, etc.
- Glass damage
- Theft
- Damage from hitting an animal
- Vehicles covered by the Pennsylvania auto insurance policy
Collision
Pennsylvania collision coverage is optional and can not be purchased without bodily injury coverage.
How much protection does this coverage provide?
Repair or replacement cost of the vehicle that has collided with other cars/objects or has rolled over.
Emergency Road Service
Pennsylvania emergency road service coverage is optional. This coverage pays for the cost of towing your car if it becomes disabled. Emergency road service coverage cannot be purchased without collision coverage.
Rental Car Coverage
Pennsylvania rental car coverage is optional and can not be purchased without collision and comprehensive coverage.
What's covered?
This auto insurance coverage pays for the cost of a rental car if you can not drive the vehicle due damage from an accident or theft.
Customized Equipment
Pennsylvania customized equipment coverage is optional and you must also have comprehensive and collision coverage.
What is covered?
Customized equipment coverage is appropriate if your vehicle has permanently installed custom parts or equipment other than those installed by the original manufacturer including:
- running boards
- brush bars
- roll bars
- undercarriage lighting
- fog lights, bed liners
- camper shells
- trailer hitches
- customized wheels
- spoilers
- performance-related equipment
- stereo equipment
- television equipment
- customized paint or decals
Loan/Lease Gap Coverage
Pennsylvania Loan/lease gap coverage, but you must also have collision and comprehensive coverage and your car must also be financed or leased.
What is covered?
This coverage protects you if your car gets damaged. You will be reimbursed for the difference between the following items:
- The actual cash value of your car at the time of the loss, less the applicable deductible and the vehicle's salvage value.
- Any greater amount owed on the vehicle at the time of loss, less any unpaid finance charges, excess mileage or wear and tear charges, any other charges or expenses associated with the loan or lease, and the vehicle's salvage value.
